What Can the Violence Against Women Act Do for Immigrants in Frederick?

The Violence Against Women Act, often shortened to VAWA, allows certain immigrants who have suffered "battery or extreme cruelty" to petition for legal status without relying on an abusive spouse or family member. This law recognizes that an abuser who holds immigration control over a victim can use that control as a tool to prevent the victim from leaving or seeking help.

Under VAWA, an eligible immigrant can petition themselves for a Green Card without the knowledge or approval of the abusive spouse or parent. This process allows a victim to pursue safety and legal status independently, which can be important for someone who fears retaliation or further harm if the abuser learns about the petition. VAWA petitions require evidence of the qualifying relationship, evidence of the abuse, and proof that the applicant has good moral character.

Who Qualifies for a U Visa?

A U visa provides temporary legal status to victims of certain crimes who have lived through significant mental or physical abuse and who have been helpful, are being helpful, or are likely to be helpful to authorities in a criminal case. Qualifying crimes include domestic violence, sexual assault, human trafficking, kidnapping, and several other serious offenses.

To apply for a U visa, an applicant generally needs certification from a law enforcement agency documenting their cooperation with a criminal investigation. This certification does not guarantee approval, but it serves as an important piece of evidence supporting the application. Applicants must also demonstrate that they suffered significant harm as a result of the crime.

A U visa can eventually lead to lawful permanent residency once the visa holder meets certain requirements, including continuous presence in the United States and continuing to assist law enforcement when reasonably requested. Our attorneys help clients gather the documentation needed to support a strong U visa application and guide them through each stage of the process.

Is There a Cap on VAWA or U Visas Issued?

VAWA self-petitions are not subject to an annual numerical limit, which means an eligible applicant can file without waiting for a visa number to become available under normal circumstances. This makes VAWA an important option for victims who need a path to safety and status without facing the delays common to other immigration categories.

U visas, on the other hand, are capped at 10,000 visas issued each fiscal year. Due to high demand, U Visas often fill up before the end of the year, which creates a substantial waiting list for many applicants. Once the cap is reached, eligible applicants who cannot receive a visa that year may be placed on a waiting list and granted deferred action or parole while they wait for a visa number to become available.

This waiting list makes timing and thorough preparation especially important in U visa cases. Our attorneys help clients file strong applications as early as possible to improve their position on the waiting list and to reduce delays wherever feasible.

VAWA & U Visa Matters in Frederick FAQs

Q

Is VAWA strictly for women?

VAWA protections extend to men, women, and children who have suffered abuse from a spouse, parent, or child who is a citizen or lawful permanent resident. Eligibility depends on the qualifying relationship and evidence of abuse rather than the applicant's gender.

Q

What information do I have to provide to police in a U Visa?

An applicant generally needs to cooperate with the investigation or prosecution of the qualifying crime and obtain certification from the law enforcement agency confirming that cooperation. The specific information required can vary depending on the case, though honesty and consistency with law enforcement are important throughout the process.

Q

Can I petition for VAWA or a U Visa during deportation?

An eligible applicant can file a VAWA self-petition or U visa application while removal proceedings are ongoing. In many cases, a pending or approved petition can serve as a basis for relief from removal, though the immigration judge will still need to review the specific facts of the case.

What Protections Come With a Green Card?

A Green Card obtained through VAWA or after a U visa provides the same rights and protections as any other form of lawful permanent residency. This includes the ability to live and work anywhere in the United States, travel out of the country and return under most circumstances, and eventually apply for citizenship after meeting the required residency period.

For survivors of abuse or serious crimes, a Green Card can also offer a sense of independence and long-term stability that was previously tied to an abuser or an uncertain immigration status. A Green Card holder also has increased protection from deportation, and they gain access to many public benefits once eligibility requirements are met.

Our attorneys help clients understand what a Green Card means for their specific situation, including how to maintain their status and what steps to take if they eventually wish to pursue citizenship.
